Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of MonitorPulse, an uptime monitoring service operated by LiquidMash (Pty) Ltd ("LiquidMash", "we", "us", or "our"), a company registered in South Africa.

By creating an account or using MonitorPulse, you agree to be bound by these Terms. If you do not agree, please do not use the service.

2. Service Description

MonitorPulse is a product of LiquidMash that provides website and server uptime monitoring, alerting, and public status pages. The service is accessible at app.monitorpulse.io.

3. Service Tiers and Pricing

MonitorPulse offers the following service tiers:

All prices are in South African Rand (ZAR). Payments are processed securely via Paystack. We reserve the right to modify pricing with 30 days' notice to existing subscribers.

4. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

5. Acceptable Use

You agree not to use MonitorPulse to:

• Monitor websites or servers you do not own or have authorisation to monitor.
• Conduct denial-of-service attacks, port scanning, or any form of network abuse.
• Transmit malware, viruses, or any harmful code through the service.
• Violate any applicable laws, including the Electronic Communications and Transactions Act (ECTA) and POPIA.
• Attempt to gain unauthorised access to our systems or other users' accounts.
• Use the service to send unsolicited communications or spam.
• Resell or redistribute the service without our written consent.

We reserve the right to suspend or terminate accounts that violate these acceptable use terms without prior notice.

6. Service Availability

We strive to maintain high availability of MonitorPulse but do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance where possible. We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our reasonable control, including but not limited to internet outages, third-party service failures, or force majeure events.

7. Limitation of Liability

To the maximum extent permitted by South African law:

• MonitorPulse and LiquidMash shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
• Our total liability for any claim arising from or related to the service shall not exceed the amount you paid to us in the 12 months preceding the claim.
• We do not warrant that the service will detect all downtime events or that alerts will be delivered without delay. MonitorPulse is a monitoring tool and should not be your sole means of infrastructure oversight.
• The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Termination

You may terminate your account at any time by contacting us at support@liquidmash.io or through your account settings.

We may suspend or terminate your account if:

• You breach these Terms or the Acceptable Use policy.
• Your account has been inactive for more than 12 months on the Free plan.
• Payment for a paid plan fails and is not resolved within 14 days.
• We are required to do so by law.

Upon termination, your monitoring data will be retained for 30 days, after which it will be permanently deleted. You may request an export of your data before deletion by contacting support.

9. Intellectual Property

MonitorPulse, its logo, and all associated branding are the property of LiquidMash (Pty) Ltd. You retain ownership of any data you submit to the service. By using MonitorPulse, you grant us a limited licence to process your data solely for the purpose of providing the service.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the service. Your continued use of MonitorPulse after changes take effect constitutes acceptance of the updated Terms.
